<p>After a federal judge fined them for &#8220;gross abuse of power&#8221; in trying to freeze the assets of Utah-based crypto startup <strong>DEBT Box</strong> on deceptive grounds, SEC attorneys Michael Welsh and Joseph Watkins resigned in April. The judge rejected the complaint just last week, and then directed the SEC to pay <strong>DEBT Box</strong> $1.8 million in legal fees.</p>
<p>A news release noted,<em> &#8220;The agency considered its budget and organizational efficiency in deciding to close the office, and it has no plans to close any other regional offices.&#8221;</em></p>
<p>The regulator&#8217;s Denver office will assume control over any enforcement authority, the SEC stated.</p>

										<content:encoded><![CDATA[<p>A federal judge has directed the <strong>United States Securities and Exchange Commission (SEC)</strong> to pay about <strong>$1.8 million</strong> in legal and receivership expenses linked to the civil lawsuit against Digital Licencing, the company operating as Debt Box.</p>
<p>Judge Robert Shelby approved an order mandating the <strong>SEC</strong> pay about $1 million for attorney fees and costs and $750,000 for receiver fees and costs in a May 28 filing in the U.S. District Court for the District of Utah. The court proceeded with a non-biased rejection of the matter the same day.</p>
<h1><strong>SEC&#8217;s Misconduct and Legal Penalties</strong></h1>
<p>The judge highlighted a March finding in which the SEC <em>&#8220;engaged in bad faith conduct&#8221;</em> over a temporary restraining order to freeze <strong>Debt Box&#8217;s</strong> assets. Later on, the company submitted paperwork to the court alleging erroneous commission data, which resulted in a threat of fines.</p>
<p>The penalties against the SEC mandated that the commission pay <em>&#8220;all attorney fees and costs arising from the improperly entered ex parte relief.&#8221;</em> Except for one $649 fee, Judge Shelby basically decided that all expenses the defendants asked for in the case were <em>&#8220;reasonable.&#8221;</em></p>
<p><em>&#8220;This is a big victory for us,&#8221;</em> claimed Debt Box in a May 28 <a href="https://x.com/TheDebtBox/status/1795543929904824522">X article</a>. <em>&#8220;It implies that the SEC cannot move forward with the case as it exists.&#8221;</em></p>
<p>The July 2023 SEC complaint against <strong>Debt Box</strong> claimed the company ran an illicit <strong>$50 million coin scam</strong>. Many in the crypto industry have referred to the company as an example of regulatory overreach because it showed records suggesting the commission had made false statements and misrepresentations in trying to obtain a temporary restraining order against the company.</p>

										<content:encoded><![CDATA[<p>Utah Judge Rejects SEC &#8216;s Case Against DEBT Box!! <strong>A federal judge</strong> decided on Monday that the <strong>SEC</strong> acted in bad faith and must pay penalties, including attorney&#8217;s fees and costs arising from a lawsuit it filed against the<a href="https://coinengineer.net/blog/crypto-com-ceo-says-bitcoin-correction-is-healthy/"> crypto</a> startup <strong>DEBT Box.</strong></p>
<p><strong>Utah U.S. District Court</strong> Judge Robert Shelby said the SEC will have to pay the legal costs arising from the interim ban order applied to <strong>Digital Licensing</strong> Inc., which operated as <strong>DEBT Box</strong> last year.</p>
<p>According to the court decision, the judge also rejected the <strong>SEC&#8217;s</strong> request to dismiss the case impartially. The case included the judge criticizing the SEC&#8217;s misleading statements and acknowledging that the institution fell below expectations.</p>
<p>Throughout the 80-page order, <strong>Judge Shelby</strong> criticized the SEC&#8217;s behavior to obtain a temporary restraining order <strong>(TRO)</strong> that included freezing of assets and a trustee appointed by the court to take over the company&#8217;s control.</p>
<p>The <strong>Judge</strong> said, &#8220;As a federal institution, it clearly stated its special status &#8211; reminding the court that it had been given this aid several times in the last decade when this immense judicial authority is requested to show that it can be trusted.”</p>
<p><strong>Shelby</strong> said, the court gave the <strong>TRO</strong> that led to the freezing of assets and &#8220;turning lives upside down.”</p>
<p><strong>Shelby</strong> said, &#8220;In the end, after the Defendants had the opportunity to give notice and respond, each of the pillars based on alleged facts constructed by the Commission to show necessary irreparable harm, crumbled under scrutiny.”</p>
<p>“This was not just a single non-definitive statement or unintentional false statement. Every support that the Commission presented and later repeated while requesting the <strong>TRO</strong> and defending the <strong>TRO</strong> turned out to be a combination of wrong, misdefined, and misleading,” he said.</p>
