Growing Crypto ETF Delays 

Franklin’s Ethereum, Solana, and XRP products were initially submitted to Cboe BZX in March, while Nasdaq received BlackRock’s Ethereum staking change on July 16, 2025. Under Section 19(b) of the Securities Exchange Act, the SEC has an initial 45-day period to act, extendable up to 60, 90, or 180 days when needed. These extensions indicate that the commission requires additional time for thorough evaluations. 

In the same week, the SEC delayed decisions on the Bitwise Dogecoin ETF and Grayscale Hedera ETF until November 12, 2025. Earlier in August, the agency also postponed the 21Shares and Bitwise Solana ETF, 21Shares Core XRP Trust, and Truth Social Bitcoin-Ethereum ETF applications. Additionally, the WisdomTree XRP Fund review was extended to October 24, 2025, and the Canary PENGU ETF decision to October 12, 2025. Current reports show over 90 crypto-linked ETF proposals under SEC review. 

Institutional Approach and Market Impact 

SEC Chair Paul Atkins introduced the “Project Crypto” initiative on July 31, 2025, aiming to modernize securities rules and integrate trading, lending, and staking into a single regulatory framework. During the OECD’s global financial roundtable in Paris, he emphasized, “The time for crypto has come,” highlighting the significance of this transformation. However, the commission continues to delay proposals for altcoins and staking-based products. 

Despite regulatory delays, Ethereum remains strong. CoinMarketCap data shows ETH trading at $4,374.51, with a market capitalization exceeding $528 billion and 24-hour trading volume over $39 billion. Over the past 90 days, ETH has gained more than 75%, signaling strong market sentiment. Institutional investors closely monitor these ETF decisions, anticipating significant liquidity and volatility shifts once approvals are finalized. 

The SEC’s approach ensures comprehensive review, safeguarding investor interests while maintaining orderly market operations. The extended deadlines provide additional time to evaluate staking features and other critical aspects before final decisions are announced.

SEC Initiates Extended Review for Solana ETF Applications

Major asset managers like 21Shares, Bitwise, VanEck, and Canary Capital have filed proposals for spot Solana ETFs. However, the SEC has yet to greenlight any fund linked to Solana, despite previously approving products for Bitcoin and Ethereum.

In its latest statements, the SEC emphasized that the delay does not signal a decision to approve or reject. Instead, the agency needs more time to evaluate the applications in light of concerns over market manipulation and investor protection—especially for proposals from Bitwise and 21Shares.

This round of review includes a formal public consultation period, inviting market participants to weigh in on the proposals before a final ruling is made.

Final Decision May Not Arrive Until Late 2025

While both 21Shares and Bitwise have strong reputations in crypto asset management, the SEC appears more cautious with Solana, which—despite its fast and low-cost infrastructure—remains outside the current list of approved ETF assets.

Bloomberg analysts James Seyffart and Eric Balchunas continue to express confidence, projecting a 90% likelihood that ETFs for Solana and Litecoin (LTC) will be approved. Still, they acknowledge that decisions may not arrive until late 2025 due to bureaucratic delays.

Investors are urged to remain patient and realistic. The approval process is moving forward—but not at the pace some may have hoped.

The SEC has begun reviewing a proposal from NYSE Arca to allow staking activities within the Grayscale Ethereum Trust ETF and Grayscale Ethereum Mini Trust ETF. The ruling is expected by May 26, 2025.

On February 14, 2025, NYSE Arca filed a request to modify rules to allow Grayscale Ethereum funds to stake ETH through trusted providers and earn rewards.

Both ETFs are already trading in the market. The Grayscale Ethereum Trust ETF was approved by the SEC in May 2024, and the Grayscale Ethereum Mini Trust ETF was approved in July 2024.

Staking Process and Regulatory Framework

The proposed changes include that staking will only be carried out by Grayscale. ETH will not be combined with other institutions and third-party staking services will not be marketed.

There will be no changes to the current custody regulations, with Coinbase Custody continuing to safeguard the ETH assets in the ETFs.

The SEC will subject the proposal to a public review process. The initial decision deadline is 45 days but can be extended up to 90 days from the publication date.

In March 2024, Grayscale Investments proposed adding staking features to its spot Ethereum ETF but faced regulatory hurdles. Fidelity also made a similar attempt during the same period.
