The SEC has taken up the review of Grayscale’s DOT spot ETF application, which could increase interest from institutional investors.

SEC Takes Up Grayscale’s DOT Spot ETF Application for Review

The U.S. Securities and Exchange Commission (SEC) has officially begun reviewing Grayscale’s application for a Polkadot (DOT) spot ETF. This development could be a significant milestone for the DOT ecosystem and may increase interest from institutional investors. If approved, the DOT spot ETF could provide investors with a direct investment opportunity in DOT, potentially enhancing market liquidity and reliability.

Grayscale had filed an official application with the SEC to list a Polkadot-based spot ETF on the exchange. The SEC’s decision to review the application signifies that the process has moved to the next stage, with the regulatory body set to conduct a detailed examination. The acceptance of this application is also being closely watched in light of the SEC’s regulatory approach toward the cryptocurrency market.

Polkadot Spot ETF Approval Could Open New Era for Institutional Investors

Following the approval of Bitcoin spot ETFs, the future of altcoin-focused ETFs has been a topic of significant interest. If approved, the Polkadot spot ETF could provide institutional investors with safer, regulated access to the Polkadot network. Additionally, this product could help stabilize DOT’s price movements and reduce market volatility.

Cryptocurrency investors and market analysts are closely monitoring the SEC’s stance on this application. The outcome of the SEC’s evaluation process will be of great significance, and if approved, it could herald a new wave of institutional investments for DOT.

SEC to Host Roundtable on the Security Status of Digital Assets

The U.S. Securities and Exchange Commission’s (SEC) Crypto Task Force is set to hold a roundtable later this month focused on the “security status” of digital assets.

This announcement coincides with the agency revealing its staffing lineup for the task force, which includes a former major law firm crypto attorney alongside long-serving SEC personnel.

On March 3, the SEC announced a series of roundtables, dubbed the “Spring Sprint Toward Crypto Clarity,” to be held at its Washington, D.C. headquarters.

The first roundtable will kick off on March 21 with a discussion titled “How We Got Here and How We Get Out — Defining Security Status.”

Crypto Task Force leader Commissioner Hester Peirce said, “I look forward to drawing on the expertise of the public in developing a workable regulatory framework for crypto.”

SEC’s Acting Chairman Mark Uyeda launched the Crypto Task Force in late January to develop a crypto framework for the agency. One of President Donald Trump’s promises was to ease regulatory enforcement of the crypto industry.

Crypto Task Force Announces New Chief Counsel and Ends Kraken Lawsuit

The agency has recently dropped several lawsuits launched during the Biden administration, including its March 3 dismissal of the lawsuit against crypto exchange Kraken.

The SEC also announced the 14 members of its Crypto Task Force on the same day, naming Michael Selig as its Chief Counsel. Selig was a partner at Willkie Farr & Gallagher, where he advised crypto, NFT, and stablecoin firms. Former CFTC Chairman Chris Giancarlo congratulated Selig.

Crypto Task Force Personnel Appointments and Future Steps

Peirce’s former policy counsel, Sumeera Younis, was appointed the task force’s operations chief. Peirce stated that the crypto task force demonstrates deep expertise and enthusiasm in identifying workable solutions to crypto regulatory problems with support from the SEC staff and the public.

Last month, Uyeda made several personnel appointments to the task force.

Coinbase attorneys said that a judge in New York should dismiss a lawsuit opened by the SEC, arguing that the agency has overstepped its boundaries.

The SEC had accused Coinbase of operating as a securities exchange, also broker and clearing agency without registering, back in June. However, the exchange responded to this allegation on Tuesday, arguing that the agency’s authority is limited to securities transactions.

You might like: Galaxy Digital Predicts a 74% Increase in Bitcoin Price After ETF Launch!

Coinbase’s Attorneys Says:

In a file, Coinbase stated, “Investment contracts give the buyer a contractual claim to future income, profit, or assets of a commercial enterprise. This is what makes them securities rather than just investments.“

“As the SEC’s complaint does not allege, and cannot allege, that the simple asset trades it describes come with ongoing contractual obligations related to a commercial venture, Coinbase has the right to decide about defenses.”

Coinbase claimed that an investment contract would be present under the SEC’s existing argument when someone expects the value of their purchase to increase or when they divest. The exchange said that this would give the SEC authority over different matters.

Coinbase said, “According to the SEC’s understanding, every sale and resale of pictures on Etsy would be a securities transaction”. They added, “Consider an artist selling pictures on Etsy with a note indicating they plan to exhibit their work in a gallery next month. Those who read the note might buy the paintings hoping that the artist’s plans to increase their visibility would increase their value.”

The SEC referred to the Howey Test, a case of the 1946 US Supreme Court, to determine whether transactions were investment contracts or not. Coinbase claimed that the SEC’s arguments in Howey were broadened “beyond recognition“.

Regulator’s request to dismiss cases filed against Ripple’s founder and CEO has stirred up controversy. The SEC requested the dismissal of the case filed against Ripple’s co-founder Chris Larsen and CEO Brad Garlinghouse.

According to a report by Bloomberg, SEC lawyers arranged a meeting to discuss and resolve violations related to the XRP sales conducted by Ripple on a corporate level. Bloomberg Intelligence analyst Elliot Stein noted that this move would reduce the risk of the SEC losing the lawsuit and shorten the time to appeal. Stein also mentioned the likelihood of not wanting negative information to become public during personal trials.

In a press release by Ripple, the SEC’s application was described as a “striking retreat by the government“. Ripple’s chief legal officer, Stuart Alderoty, said on social media, “This is not a settlement. This is the SEC backing down“.

In a press release issued by Ripple, the SEC’s filing was characterized as a “dramatic U-turn” by the government. Ripple’s Chief Legal Officer, Stuart Alderoty, also used social media to state, “This is not a settlement. This is the SEC stepping back.“
