										<content:encoded><![CDATA[<p>Sources close to the situation have revealed that the <a href="https://coinengineer.net/blog/u-s-cracks-down-on-cryptocurrency-use-in-child-abuse-trade/">US Department of Justice</a> (DOJ) has entrusted the worldwide consulting firm <a href="https://www.forensicrisk.com/about/who-we-are">Forensic Risk Alliance</a> (FRA) with the responsibility of overseeing <strong>Binance&#8217;s</strong> compliance with regulatory mandates for the next three years.</p>
<p><strong>Binance</strong> was required to appoint an independent entity to oversee the exchange&#8217;s compliance for the subsequent three years as part of its plea agreement in November 2023, when it pleaded guilty to various criminal offenses, including money laundering, and paid a fine of $4.3 billion. According to a Bloomberg story from May 10, the FRA will be able to examine the company&#8217;s internal records, facilities, and personnel in order to notify the DOJ of the company&#8217;s operations.</p>
<p>The DOJ apparently first considered appointing Sullivan &amp; Cromwell to the contract but ultimately decided to go with FRA due to the firm&#8217;s history of representing the defunct cryptocurrency exchange FTX. Creditors said in a court document that S&amp;C was aware of the failures, dishonest and fraudulent actions, and theft of money from Class Members by FTX US and FTX Trading Ltd.</p>

<p>Nevertheless, Sullivan &amp; Cromwell is supposedly in the running to represent <strong>Binance</strong> in a separate five-year monitoring role for the Financial Crimes Enforcement Network of the Treasury Department.</p>
<p>The alleged appointment is happening just weeks after <strong>Binance&#8217;s</strong> previous CEO, <a href="https://coinengineer.net/blog/binance-founder-cz-sentenced-to-four-months-in-prison/">Changpeng &#8220;CZ&#8221; Zhao</a>, received his prison sentence. For failing to keep the cryptocurrency exchange&#8217;s Anti-Money Laundering program functional, Zhao received a four-month prison sentence on April 30.</p>
<p>Given the lack of evidence linking Zhao to certain unlawful conduct at <strong>Binance</strong>, Judge Jones reduced the prosecution&#8217;s original three-year prison term.</p>

<p>Federal agencies should have the capability of detecting transactions on cryptocurrency that are connected to the trade of child abuse content, as suggested by U.S. Senators Elizabeth Warren and Bill Cassidy.</p>
<p>Within this move towards the eradication of CSAM, the Department of Justice (<a href="https://coinengineer.net/blog/samourai-wallet-charged-with-money-laundering-conspiracy/">DOJ</a>) and <a href="https://www.dhs.gov/">Department of Homeland Security (DHS)</a> were asked to reveal their existing technical capabilities.</p>
<p>The senators used a Chainalysis investigation from January 2024, which stated that illegal trading of CSAM was done more often using cryptocurrencies.When conducting the research.</p>
<p>Chainalysis reports that “mixers” and “privacy coins” like <a href="https://coinengineer.net/blog/monero-xmr-community-funding-wallet-stolen/">Monero (XMR)</a> are used by vendors of child abuse goods to hide their assets and evade authorities.</p>

<p>In letters to Attorney General Merrick Garland and Secretary of Homeland Security Alejandro Mayorkas, U.S. senators expressed their desire to know the capabilities of the DOJ and DHS in identifying and prosecuting these offenses.</p>
<p><em>“The current anti-money laundering (AML) rules and law enforcement approaches struggle to detect and avoid these crimes.”</em></p>
<p>The letter had six questions in total, with three directed specifically at the separate conclusions of the federal agencies regarding the relationship between bitcoin and CSAM. The rest were about discovering what further tools were required for the investigation of buyers and sellers.</p>
<p>The senators expect to learn the answers to their questions by May 10.</p>
<p>The indictment of KuCoin and its two founders was prompted by the DOJ&#8217;s present technical capability to investigate cryptocurrency transactions.</p>
<p><em>&#8220;Conspiring to operate an unlicensed money transmitting business&#8221;</em> and BSA violations were among the charges levied against KuCoin and its two founders by the DOJ on March 26.</p>
<p>“In failing to implement even basic Anti-Money Laundering policies, the defendants allowed KuCoin to operate in the shadows of the financial markets and be used as a haven for illicit money laundering.”</p>
<p>The U.S. Department of Justice claims that KuCoin handled over $4 billion in &#8220;suspicious and criminal funds&#8221; and over $5 billion in transactions.</p>

<p>The Department of Justice stated that it will closely monitor Binance’s activities, especially in areas such as money laundering. The previous agreement includes FinCEN’s authority to provide oversight for five years, and these oversight activities could cost the exchange millions of dollars. Former SEC official John Reed Stark stated that Binance’s agreement grants the DOJ, FinCEN, and other financial regulators broad access and audit authority for years.</p>

<p>Binance’s former CEO Changpeng Zhao and the company admitted to violating U.S. laws by agreeing to pay a fine of $4.3 billion on November 21. The SEC came forward with 13 charges against Binance on June 5, claiming that products related to BUSD and BNB tokens were unregistered and also alleged that the institution operated as an unregistered broker.</p>
<p>The SEC expressed its desire to receive “fair notice” about the facts of Binance’s agreement from the court, objecting to Binance’s request for dismissal of the case. This situation reflects Binance’s contentious situation with U.S. regulators.</p>
