The U.S. Commodity Futures Trading Commission (CFTC) has presented its plan for listing spot crypto on registered futures exchanges for public comment. The agency is collecting feedback until August 18 to finalize its roadmap.

Acting Chair Caroline Pham stated that the current legal framework could be applied without the need for new regulations. She emphasized that spot crypto assets could be traded through designated contract markets (DCMs). This approach directly conflicts with the SEC’s securities interpretations.

CFTC-registered DCM platforms like CME Group and ICE Futures US operate under strict supervision and customer protection measures. The plan would allow these platforms to list physically settled crypto contracts.

However, Pham opposes complex regulations similar to Europe’s MiCA. She advocates for streamlined and effective solutions to maintain the U.S.’s market leadership.

SEC-CFTC Conflict

Some legal experts warn that the plan carries significant risks. Andrew Rossow, CEO of AR Media Consulting, pointed out that crypto assets cannot be rigidly categorized. According to Rossow, assets may acquire security characteristics over time, threatening regulatory stability.

The CFTC’s authority is limited to leveraged or collateralized transactions conducted only through DCM platforms. Meanwhile, the SEC still classifies many cryptocurrencies as securities under the Howey Test.

Rossow emphasized that this dual framework doesn’t align with the dynamic nature of crypto assets. Even if investors comply with CFTC rules, they may face retroactive SEC enforcement actions.

Moreover, this situation could trigger various legal consequences such as unregistered securities trading or brokerage violations. Consequently, even if the plan is implemented, a lack of coordination between agencies increases risks.

CFTC Moves to Accelerate Crypto Regulation in the U.S.

Caroline Pham aims to implement spot crypto regulations within 12 to 18 months, positioning the U.S. as a global crypto hub.

However, without resolving uncertainties around securities-commodity distinctions, such steps could lead to further legal confusion. Also, listings made without clear investor protections may undermine trust.

The U.S. Securities and Exchange Commission (SEC) is organizing a new series of roundtable discussions under its “Project Crypto” initiative. The events will take place across 10 cities between August 4 and December 5. With this effort, the SEC aims to engage directly with small-scale crypto startups.

Led by the Crypto Task Force, these roundtables were announced shortly after Commissioner Paul Atkins revealed the new initiative. The SEC intends to build a more inclusive and regulatory-friendly environment within the crypto ecosystem. Priority will be given to projects that have fewer than ten employees and have been operating for less than two years.

The first meeting will be held on August 4 in Berkeley, California. Additional sessions will follow on August 19 in Boston and September 4 in Dallas. Chicago and New York will host the next roundtables on September 15 and September 25, respectively.

Small Projects Take the Spotlight at SEC Roundtables

In the past, SEC roundtables primarily featured major players like BlackRock and Fidelity. This time, however, the focus shifts to less recognized startups.

Commissioner Hester Peirce stated that the agency wants to hear from those who haven’t previously participated in policymaking. The goal is to ensure new regulatory frameworks are suitable not only for large corporations but also for small and innovative teams.

Meanwhile, Project Crypto also addresses foundational regulatory issues, such as the classification of digital assets and the registration of crypto products. Additionally, the SEC is working toward transitioning U.S. financial markets to on-chain infrastructures.

Three more meetings are scheduled in October: Irvine on the 3rd, Cleveland on the 24th, and Scottsdale on the 29th. The final two roundtables will take place on November 12 in New York and December 5 in Ann Arbor.

Project Crypto Signals a New Era in SEC’s Approach to Web3

With Project Crypto, the SEC demonstrates a more open approach toward the digital asset ecosystem. Through this initiative, the agency aims to deepen engagement with industry stakeholders across the country. Meanwhile, FED member Kugler announced that she will resign on August 8

These upcoming sessions offer critical opportunities for voices left out of prior regulatory processes. They also help democratize future policy development.

Ultimately, the SEC is using Project Crypto as a platform to reshape its relationship with the crypto sector—one roundtable at a time.

The U.S. Securities and Exchange Commission (SEC) has implemented a significant change for exchange-traded funds (ETFs) based on cryptocurrencies. With the new rule, Bitcoin and Ether ETFs are now allowed to process “in-kind” transactions — meaning shares can be created or redeemed directly with crypto assets instead of cash.

SEC Chairman Paul Atkins described this move as the beginning of a new era for crypto markets. According to Atkins, the change will lower costs and bring greater efficiency for ETF issuers and investors alike.

Previously, only cash-based transactions were allowed. Now, authorized participants can use digital assets directly when creating or redeeming ETF shares. This shift reduces pressure on the market and allows for smoother, more cost-effective operations.

What Does the New System Offer? Greater Efficiency in Crypto ETFs

Jamie Selway, Director of the SEC’s Division of Trading and Markets, said the in-kind mechanism provides flexibility and cost advantages for fund issuers. Additionally, funds can now operate without having to sell crypto assets, which helps minimize tax burdens.

To recall, the SEC approved spot Bitcoin and Ether ETFs back in 2024, but limited them to cash-based processes. Since then, the crypto industry has consistently called for in-kind options.

Just last month, SEC Commissioner Hester Peirce acknowledged the demand during her speech at the Bitcoin Policy Institute conference. In short, this regulatory move marks a long-anticipated shift within the crypto sector.

Meanwhile, recent developments in Congress have also accelerated this transition. Lawmakers passed three major crypto-related bills addressing market structure, stablecoin regulations, and opposition to a surveillance-driven central bank digital currency (CBDC). These legislative changes align with the Trump administration’s pro-crypto stance.

Growing Demand for Bitcoin and Ethereum ETFs

U.S. spot Bitcoin ETFs have recorded over $6.6 billion in inflows across the last 12 trading days. According to Bitbo data, these funds now hold approximately 1.298 million BTC — valued at around $152.1 billion.

On the Ethereum side, BlackRock’s iShares Ethereum ETF has gained attention for its rapid growth. The fund surpassed $10 billion in assets in just 251 days, becoming the third-fastest ETF to reach that milestone.

In summary, with SEC approval of in-kind transactions, crypto ETFs enter a new chapter. This rule not only boosts efficiency but also supports broader regulatory reform across the digital asset landscape.

Trump aims to have the bill enacted by Independence Day, July 4. However, crypto regulations are complicating his July 4 deadline.

Senate discussions are dragging on as senators review hundreds of amendments through rapid votes. Debates often extend into late nights, delaying the process and threatening the July 4 target.

Crypto Tax Exemptions and Lummis’ Proposals

Two key crypto market proposals are under consideration in the bill. Republican Senator Cynthia Lummis suggests exempting transactions under $300 and annual transfers below $5,000 from taxation. She also requests that staking, airdrop, and mining income be taxed only upon sale, aiming to prevent double taxation. These proposals were extensively discussed at the 2025 Bitcoin Conference.

Democrats’ Ban Proposal and Senate Decision

Meanwhile, Democratic Senators Elizabeth Warren, Jeff Merkley, and Jack Reed proposed banning government officials from owning and promoting crypto, including their spouses and children. The Senate rejected this proposal, intensifying debates over crypto regulations.

The Republicans’ slim majority in the Senate slows the progress. Afterward, the bill will proceed to the House of Representatives, further extending the timeline. The legislation promises to solidify the country’s position as a global leader in digital assets, especially in the stablecoin sector.

Trump: “NO DELAYS, NO ADD ONS”

After the Senate passed the GENIUS (Guiding and Establishing National Innovation for US Stablecoins) Act with a 68–30 vote, Trump posted on Truth Social urging quick House approval.

“The Senate just passed an incredible Bill that is going to make America the UNDISPUTED Leader in Digital Assets,” he wrote. “Get it to my desk, ASAP — NO DELAYS, NO ADD ONS.”

You Might Be Interested In: Elon Musk Talks About the Name of a New Memecoin!

With a narrow Republican majority in the House, the final vote is pending — but all eyes are on how swiftly it can reach Trump for final approval.

What Does The Bill Include?

The GENIUS Act aims to establish a clear regulatory framework for stablecoins, including:

Mandatory 1:1 reserve backing

State or federal-level licensing

Anti-Money Laundering compliance

Strict consumer protections

Limits on how reserves can be used (e.g., only for redemptions or low-risk Treasury investments)

These measures are designed to eliminate shadow banking risks and enhance systemic trust in dollar-backed stablecoins.

Controversy Still Looms

Although now progressing, the bill had previously failed a cloture vote in May due to Democratic concerns. Critics like Senator Elizabeth Warren accused Trump and his family of positioning to earn “hundreds of millions” from a proposed USD1 stablecoin if the law passes. Others warned against falling behind globally in crypto adoption and innovation.

Hopes for Leniency Dashed

Mashinsky’s defense argued for a lighter sentence — 366 days — citing his clean record, military service, and guilty plea. However, federal prosecutors pushed for a 20-year term, stating that Mashinsky targeted retail investors, not institutions. This fact ultimately led the court to impose a harsher penalty.

Trump’s Pardon Legacy Fails to Influence Outcome

Former President Donald Trump previously pardoned high-profile crypto figures like Ross Ulbricht and BitMEX executives, raising hopes in some circles for clemency. Yet this case proved different. Despite arguments comparing him favorably to Sam Bankman-Fried, the court delivered a severe verdict.

With figures like Changpeng Zhao seeking clemency and others like Roger Ver and SBF under legal scrutiny, this ruling sets a precedent that crypto fraud, regardless of innovation or intent, will not be tolerated.

In a letter dated April 11, Palacios said the bill “presents several legal issues and may be unconstitutional.” While the bill primarily aimed to regulate internet casino licensing, it also included a clause granting the Tinian Municipal Treasury authority to issue and manage the MUSD.

Stablecoin Hidden Within Internet Casino Bill

The legislation, introduced by Republican Senator Jude Hofschneider in February, sought to amend local law to allow internet-only casinos on Tinian.
The four-member Tinian delegation passed the bill unanimously on March 12. However, Palacios objected to its overreach, saying it lacked strong measures to combat illegal gambling activities and overstepped local jurisdiction.

Had it passed, the bill could have made Tinian the first U.S. government entity to issue a stablecoin, beating Wyoming, which plans to launch its state-backed coin in July.

The stablecoin launch was intended to coincide with Google’s $1 billion subsea cable project running through Tinian, enhancing the island’s digital connectivity.
