According to him, drafting action memos, reviewing them through internal divisions, and scheduling commissioner votes are standard steps that take time. “That’s not the cause for delay,” he wrote, dismissing speculations of secret talks between Ripple and the SEC. 

SEC’s Bureaucratic Process Slows Ripple Lawsuit 

Fagel made it clear that the delay stems from bureaucratic obligations. The process begins with preparing an action memo, which then must be reviewed by relevant departments. Only after this review can it be placed on the calendar for a commissioner vote. This sequence, he noted, may take 1 to 2 months. 

Following the closed-door meeting on July 3, the community expected significant progress. However, no decision came out of the July 17 session either. Fagel emphasized that these meetings are routine weekly events with no direct link to the Ripple case. 

He also debunked rumors blaming Judge Torres or the SEC for intentionally stalling the process. “Nobody is holding up the case,” he said. Furthermore, he clarified that Ripple’s $125 million fine was paid in cash, not in XRP, and this does not signal the end of the case. The final resolution still depends on the SEC’s appeal status. 

Hope for a Quick Settlement Might Be Premature 

Despite Ripple dropping its appeal, which sparked hope for a swift resolution, Fagel remains skeptical. He warned the community against believing anyone claiming to know the exact timing, reiterating that no one truly knows when a settlement vote will be scheduled.

The ongoing XRP lawsuit between Ripple and the SEC has reached another critical point. U.S. District Judge Analisa Torres of the Southern District of New York rejected the joint motion for a ruling and settlement submitted by both parties. Hopes for a swift resolution have been temporarily delayed. 

Ripple and the SEC had requested the $125 million penalty be reduced to $50 million and certain obligations to be lifted. However, the court found that this motion was not properly filed. 

Court Speaks Clearly: Procedural Errors Determine the Outcome 

Judge Torres referred to Federal Rule of Civil Procedure 60(b). The parties failed to consider this rule in their submissions. This rule only allows exceptions under extraordinary circumstances. Therefore, the court stated it could not review the motion. Additionally, presenting the requests as a settlement did not simplify the process. The court emphasized its duty to consider the public interest. The parties’ expectations were not met. 

Defense attorney James Filan explained on social media that the decision was based on procedure. According to him, the requests were not rejected but were dismissed due to incorrect filing. Meanwhile, legal expert Fred Rispoli warned about the process ahead. He said Ripple and the SEC would refile their motion properly. However, this time, the court must be convincingly persuaded of the public interest. 

XRP Price Drops 

Following the decision, XRP experienced a sharp decline. Losing over 4%, XRP fell to around $2.45. Naturally, this caused anxiety among investors. The prolonged lawsuit has reduced short-term market confidence. Ripple’s Chief Legal Officer, Stuart Alderoty, stated that the ruling does not affect the determination that XRP is not a security. He also emphasized that both parties agreed on the settlement and will revisit the court process. 

Legal analysts MetaLawMan and Bill Morgan also issued warnings. Both believe it has become more difficult for judges to overturn previous rulings. This means the case will become more complicated for Ripple and the SEC.

SEC Appeals Ripple Labs Case Ruling

The SEC’s interim appeal comes almost a month after Judge Analisa Torres issued her ruling. The United States Securities and Exchange Commission’s decision to challenge the court ruling from July in the Ripple Labs case was based on the determination that they did not consider the sale of XRP to retail investors as a security.

In a letter dated August 9th sent to Judge Analisa Torres, the SEC stated that it believes an appellate court should review the decision. During the appeals process, the SEC requested a suspension of the case and pointed out that the outcome of the appeal could affect several other court cases. The SEC has legal disputes with various cryptocurrency companies, including Binance and Coinbase, over alleged securities violations.

The SEC justified the interim appeal based on two significant legal issues. Moreover, these issues involve complex legal questions and encompass a wide area with a range of diverse opinions. Furthermore, a jurisdictional split within the region had already starkly highlighted these differences. Therefore, the SEC firmly asked the court to confirm its decision that Ripple’s programmed XRP offerings and individual sales on cryptocurrency exchanges were not to be classified as securities. Additionally, the SEC mentioned the judge’s ruling in the Terraform Labs case, where the judge suggested that cryptocurrencies sold on crypto exchanges could be regarded as securities.
